Corporate (Company) User Agreement

Article 1 — Parties

This agreement is a usage agreement concluded between SGATOUR KONGRE ORGANİZASYON ULAŞIM HİZMETLERİ SANAYİ VE TİCARET ANONİM ŞİRKETİ (“SGA”) on one side and the platform member user (“MEMBER”) on the other. SGA and the MEMBER are together referred to as the “PARTIES”.

Article 2 — Purpose and Subject

The subject of this agreement is to set out the purchase and terms of use of the transport services offered by SGA to its members in Turkey and abroad through its platform.

Article 3 — Definitions

Service: Services that bring together members and road-transport companies/drivers on the platform and facilitate the performance of transport/logistics services.
Platform: The mobile applications and website written specifically for SGA, where the terms of purchase, payment and use of transport services are shared with members.
Reservation: The records — including departure point, departure time, route, destination and member/passenger details — relating to the performance of the transport service accepted after payment.
Shared Vehicle / Passenger: Vehicles in which, with prior notice, customers may travel together, and the customers travelling together in such vehicles.

Article 4 — Membership

Membership is established when the information requested through SGA’s mobile and internet applications is completed fully and accurately and the user accepts this agreement. The member declares that their phone, e-mail and other requested details are current and valid, and that the membership information complies with the law and morality. The member may leave membership at any time via the exit functions; termination does not remove existing obligations for completed services.

Article 5 — General Terms and Use

The member may make reservations through the platform, limited to the provinces and countries where SGA operates. Confirmations and payments are made by credit card in accordance with consumer law.
A reservation may be changed or cancelled free of charge at least 3 hours before the trip if departure and arrival are in the same city, or at least 6 hours before if in different cities. For cancellations not made within these times, the platform usage fee is not refunded.
For shared trips, cancellation/change is possible up to 6 hours before the trip; no refund or change is possible thereafter.
SGA may inform members about promotion codes, campaigns, surveys and customer-satisfaction activities by e-mail and SMS. The member may withdraw consent for commercial electronic messages at any time by e-mailing info@sgatour.com.tr.

Article 6 — Rights and Obligations of the Parties

When creating a transfer request, the member must correctly enter the name and identity/passport details of the actual person who will use the service. The member is responsible for the confidentiality of membership passwords and for transactions made with them. Despite taking the necessary security measures, SGA cannot be held directly liable for unauthorised acquisition of member data. SGA reserves the right to change the scope of the service, the platform content and the software at any time.

Article 7 — Term and Termination

This agreement takes effect from the date of acceptance and remains in force unless terminated by the parties. The parties may terminate the agreement at any time by notice through the platform; obligations accrued up to the termination date remain reserved.

Article 8 — Right of Withdrawal

The member may exercise the right of withdrawal up to 3 hours before the trip for intra-city reservations and up to 6 hours before for inter-city reservations. There is no right of cancellation, change or withdrawal for shared trips. If these times are not observed, the member has no right to cancel or change the reservation.

Article 9 — Protection of Personal Data

The member’s personal data may be collected and processed in written or electronic form under Turkish Personal Data Protection Law No. 6698 (KVKK). Data is retained for the periods required by applicable legislation; at the end of these periods it is deleted, destroyed or anonymised under Article 7 of the KVKK.

Article 10 — Miscellaneous

The terms and conditions announced at www.sgatour.com.tr for the services offered by SGA form an integral part of this agreement. The invalidity of any provision does not affect the validity of the others. The Istanbul Courts and Enforcement Offices have jurisdiction over disputes arising from this agreement. By completing membership through the platform, the member is deemed to have accepted all terms of this agreement.
